I see all these places asking for prewritten checks or many months in advance. Forget it. I wouldn't deal with that garbage either. Even leases seem like a bad idea to me. I heard that they can go after you for leases. Maybe even not allow you to leave if your sued in court? If you sign a 6 month lease and leave after 3 months can the owner sue you for 3 months due of rent? Unlikely but if they do your in big trouble cause maybe youll have a hold departure. Maybe you know more about that aspect.

+Mrs. Hemminger Yep. When we left Angeles City I had not quite finished my two year contract so I paid the remaining 3-4 months. The girl was surprised when I came in and told her I wanted to pay the balance before leaving the country. But they were really good to me and installed it when I first arrived in Angeles despite the fact that I didn't have any documentation (like a proof of address). I figure it was the right thing to do and there was no need to burn any bridges there in Angeles City.

+Kevin SandersThis issue can also come up with internet contracts where they try to lock you in for 2 years.  The difference though is if you dont pay back you definitely can't reuse their internet so there is an incentive to pay back them in some ways.I guess it depends on how ingrained into the country you are.   it deosn't seem like they could do a hold departure.  It have to be held by the immigration which is a seperate issue.  I guess one could suppose it could escalate to an immigration issue even you overabused it. Recently singer chris brown where he ran up a huge restaraunt bill and got a hold departure but that was a criminal act not a civil lawsuit and he is famous.Maybe if one had tons of lawsuits or something but odds of one lawsuit or 2 from a disgruntled landlord are slim.  I would think most would just move on and find someone else.  i doubt youd be referred to immigration over a lease break.  LOLIf you dont own any property as a foreigner or any assets dont see  how they could come after you.  well maybe if you have a bank account locally they could seize the money if you have a lawsuit.

+Mrs. Hemminger Well, one incentive is the desire to stay in the Philippines. If you plan to live there it wouldn't be a good idea to have legal issues there. That's one reason I tried to avoid any kind of issue like that.

+Kevin Sandersyeah It seems like there is no legal recourse on a foreigner.  Maybe they give lower rates cause they assume most tenats are filipino who they could go after but as a foreigner it seems like as long as you dont own anything they can't go after you (immigration is the main leverage they have but it seems like they can't use that).   So really there is no incentive for a foreigner to even follow a lease.  So i guess might as well sign one.  LOL

+Mrs. Hemminger Yes I never heard of a foreigner being on hold departure for something like that. It's one of the reasons I didn't mind paying the 2-3 month security deposit (plus the utility deposit). The landlord is taking a risk, too.

+Kevin SandersI did some searching around and i went to a  philippine law blog and they said that not even bad check writing can get a hold departure.  Im surprised to hear this.  it seems like a tourist could wrack up a bunch of bad leases and not be culpable also if one can write bad checks and not get a hold departure.  I dont know if have to research this more but it seems like if the lease has no ability to go after a tourist by blocking his immigration it seems like it would be easy to break leases LOLEven if a criminal case under B.P. 22 is filed, the court cannot issue a hold-departure order. All violations of the Bouncing Checks Law, regardless of the amount involved, are filed only with the municipal/metropolitan trial courts. These courts cannot issue a hold-departure order.

+Mrs. Hemminger Technically they are not allowed to do that and I could have gone to city hall and forced them to turn it back on if they had. But at that point I was just trying to get out of there with minimal hassle. I think you'll find that most renters are more reasonable. Our landlord in Angeles City didn't try to rip us off or hassle us because we had been there for over a year and fulfilled the lease. I don't remember the exact arrangement but we worked something out when my wife's visa was approved and we had an exit date.

+Mrs. Hemminger Not really. I had been there for 9 years at that point. My decision to move was kind of quick and I thought they might do something like cut my water off if I didn't pay rent on a given month (they had done that to other renters for similar reasons). They were just completely unethical so for me it was a matter of getting out of there and just hoping that I could get part of the deposit back. The only reason they gave some of it back was because of my broker who found the place for me. I think they didn't want to destroy her trust.

+Mrs. Hemminger I forgot exactly how I handled it when I left Angeles and moved to the States, but I think we didn't pay for the last month or two. Our landlord there was OK so we were able to work it out (I had finished my one-year lease so it was OK). When I left Manila to move to Angeles I lost about half of a 40k deposit. The management of that place was awful so I was fortunate to get anything back.

+Kevin SandersI guess before you moved you just didn't pay the last 2 or 3 months?  or did you just expect a refund after you left?  I heard someone suggest that since you can't expect to get a refund when you move so better to just not pay the last months you stay there.I saw an nice place near makati online and they had month to month for higher price but if you did longer and longer leases they were willing to bring the price down. ive seen that methodlogy at other listings before too.  so it seems like if you want a shorter lease or no lease youll just have to pay a little more.  But there must be a reason for this because they know they can sue you.  why else would they be so eager to get you to pay less to sign a longer lease.  It must be cause they know they can go after us LOLI think its under the law code they can blacklist or hold you for any outstanding lawsuits.  I think someone had to pay a SMART contract or something cause they owed it.  Im not sure but thats something i remember from a long time ago.   Odds are slim of being sued though but it makes me want to aim for no lease or 6 month lease at most cause what if i hate the place and want tomove id hate to be in more than a 6 month lease.

+Mrs. Hemminger I always had one-year leases. You could find month-to-month places I guess but the quality will not be as good as ones with leases. They may be able to sue you, but I doubt they could keep you from leaving the country (possible I guess, but it seems unlikely it would happen over a rent dispute). As long as you didn't trash the place they would probably consider a lawsuit a waste of money and just look for the next renter.
